In addition to providing arbitration and mediation services in commercial cases involving U.S. residents and companies, the economic impact of globalization has increased the need for resolution of international business disputes and Merton Marks has experience and background in international business arbitration and mediation. He has heard cases involving parties from Korea, Iraq, Pakistan, Romania, Peoples Republic of China, Japan, Mexico and Canada. He also served as an arbitration consultant to a German reinsurer in a complex reinsurance arbitration involving a U.S. insurer.

During the 27 years that he was a partner in the Phoenix, Arizona law firm of Lewis and Roca LLP he chaired a litigation group representing multinational corporations from the United States, Japan, Taiwan, Mexico, Canada and other countries in litigation involving insurance and reinsurance underwriters, manufacturers, investors, automobile manufacturers and dealers and hotels. He was national coordinating and supervising counsel and trial counsel in litigation, arbitrations, mediations, class actions, appeals and administrative hearings.

He is a Certified Arbitrator for the Reinsurance and Insurance Arbitration Society (ARIAS-US) (Association Internationale de Droit des Assurances, Geneva, Switzerland) and has been elected a Fellow of the Chartered Institute of Arbitrators, London. He was one of eleven arbitrators in the United States appointed to the International Panel of the Singapore International Arbitration Centre and served for two terms. He is a member of the Chicago International Dispute Resolution Association and is listed in Who’s Who in the World, Who’s Who in America and Who’s Who in American Law.

He has traveled extensively in Europe, the Middle East, South America, the Caribbean and Australia and has worked closely with business executives and lawyers from countries in those areas as well as Asia. He is familiar with their cultures and with their business and social customs. He has lectured on arbitration and mediation at conferences of the International Bar Association, International Trademark Association, American Arbitration Association and other legal and business groups in Canada, France, Germany, Israel, Spain, England and the United States. He is the author of more than 50 published articles including “Recent Trends in Arbitration” (published by the American Board of Trial Advocates in Voir Dire magazine). In 1994 he received special recognition at the Tenth Annual Conference on Legal Medicine in Jerusalem for his original research on “Recovery of Damages for Fear of Future Disease”- -a cause of action that was then beginning to emerge in U.S. courts. In 2005, he spoke on “Commercial Arbitration in China and Singapore” at an international conference in Seattle, Washington on Doing Business with Asian Nations. At a 2006 conference in Seattle he spoke on “Commercial Arbitration in China, Singapore and Korea and Considerations in Drafting International Arbitration Clauses.” In 2007, he was the speaker on “Arbitrating and Mediating Real Estate Disputes Between U.S. and Chinese Entities” at an American Conference Institute in San Francisco. In 2008, he spoke at an Asian business conference in Seattle on arbitration and mediation of intellectual property disputes and in 2009 he lectured on drafting international arbitration agreements at the annual meeting of the State Bar of Arizona.
